Buying property in Portugal

Title, debts, planning and local letting rules for international buyers in Portugal, and why completion funds should wait on a lawyer.

Urban and rural purchases in Portugal both need legal checks: title, debts, planning and, where a short let is intended, the local letting rules. Those rules are local and have tightened in some cities. Lisbon, Porto and the coast are the markets internationals most often compare, which does not make them the same market.

Taxes and fees sit on top of the price. Completion funds should not move until your lawyer is content. If savings are in another currency, the euro amount you must send still has an exchange rate and a source-of-funds file.

What to weigh

Questions to confirm

  • What do the title, debts and planning position actually show?
  • If you intend to let the property, what does this municipality currently allow?
  • Which taxes and fees apply to this price and this buyer?
  • Who must approve the transfer of completion funds, and which documents will the bank ask for?

Common questions

Is buying in Lisbon the same process as buying on the coast?

The legal checks are the same kind of work. Letting rules, prices and local practice are not. Use the municipality of the property, not a national average.

Can I assume a property can be used as a short let?

No. Short-let rules have tightened in some cities. Ask about the specific property and the current local rule before you price rental income into the purchase.

Should I send the deposit as soon as an offer is accepted?

Send what the contract requires, when your lawyer is content, and not before the bank’s questions about source of funds have a realistic timetable.
